บทคัดย่อ :

 บทความนี้ต้องการฉายภาพให้เห็นถึงความเชื่อมโยงระหว่างนโยบายรัฐ สิทธิ และความขัดแย้งผ่าน ความเคลื่อนไหวทางสังคมเพื่อปกป้องทรัพยากรและสิ่งแวดล้อม และวิถีชุมชน โดยรวบรวมเหตุการณ์ที่เกิดขึ้นระหว่างปี พ.ศ. 2525-2554 จากเอกสารทางวิชาการ งานวิจัย และสื่อสิ่งพิมพ์หลากหลาย เพื่อตรวจสอบและได้ข้อมูลที่มี ความน่าเชื่อถือ ตลอดจนการสัมภาษณ์จากผู้ได้รับผลกระทบ ใช้การวิเคราะห์และสังเคราะห์ข้อมูลดังกล่าว โดยผลการศึกษาพบประเด็นสำคัญ กล่าวคือ ประการแรก ข้อมูลการตรวจสอบของคณะกรรมการสิทธิมนุษยชนแห่งชาติบ่งชี้ว่าโครงการขนาดใหญ่ของรัฐจำนวนมากละเมิดต่อสิทธิของชุมชนโดยในกระบวนการประเมินผลกระทบด้านสังคม หรือด้านสิ่งแวดล้อม หรือด้านสุขภาพมีลักษณะการดำเนินการที่ไม่สมบูรณ์และขาดความโปร่งใส ประการที่สอง หลายชุมชนได้รับผลกระทบด้านสุขภาพอย่างรุนแรง หรือต้องเผชิญกับสิ่งแวดล้อมที่มีมลพิษ หรือการสูญเสียทรัพยากรสำคัญและกระทบต่อวิถีการดำรงชีวิตของชุมชน ซึ่งสิ่งเหล่านี้สะท้อนถึงความไม่เป็นธรรมในการแบ่งปันและเข้าถึงทรัพยากร ประการที่สาม การละเมิดต่อสิทธิขั้นพื้นฐานในการรับรู้ข้อมูลข่าวสารของประชาชน โดยส่วนใหญ่ข้อมูลข่าวสารเกี่ยวกับโครงการต่างๆ ขาดความชัดเจนและไม่ครอบคลุมทุกมิติของผลกระทบที่อาจจะเกิดขึ้น ประการที่สี่ การเข้าถึงกระบวนการยุติธรรมยังไม่มีทั่วถึงเท่าที่ควร โดยตั้งข้อสังเกตจากจำนวนคดีความขัดแย้งด้านสิ่งแวดล้อมที่เกิดขึ้น อย่างต่อเนื่องเป็นจำนวนมาก ขณะที่พัฒนาการของกระบวนการยุติธรรมด้านสิ่งแวดล้อมเป็นไปอย่างล่าช้า และประการสุดท้าย โครงการขนาดใหญ่ของรัฐยังคงเกิดขึ้นเพื่อผลิตซ้ำความบอบช้ำของชุมชน         จากอดีตจวบจนปัจจุบัน หลายฝ่ายพยายามแสวงหาทางออกของปัญหา สำหรับผู้เขียนมีความคิดเห็นว่าการถอดบทเรียนและสร้างองค์ความรู้จากความทรงจำร่วมในอดีต เป็นอีกแนวทางหนึ่งที่นำไปสู่การปรับตัวไปในทิศทางเชิงบวกได้ โดยภาครัฐต้องยอมรับชุดความรู้และเข้าใจในความแตกต่างและซับซ้อนของความเป็นชุมชน ตลอดจนควรทบทวนและปรับนโยบายให้สอดคล้องกับบริบทและเงื่อนไขของชุมชน ขณะที่ชุมชนควรเรียนรู้ตนเองทั้งในด้านทรัพยากรและการตระหนักในสิทธิของตน เรียนรู้บทเรียนแห่งความบอบช้ำของชุมชนอื่นในอดีตเพื่อสร้างสำนึกความเป็นชุมชนให้เกิดขึ้นอย่างแน่นแฟ้น ตลอดจนการเรียนรู้กระแสโลก และที่สุดแล้วความรู้จะเป็นอำนาจของชุมชน สร้างความเข้มแข็งให้กับชุมชน

Abstract :

 This article illustrates the link between state policy and community rights and conflicts through social movements in protecting community’s resources and environment, and its way of life. Events happening between 1982 and 2011 were collected from academic documents, research reports, various printed media as well as data collected from interviewing people affected by the projects in order to cross-check and obtain reliable data. The data were then analyzed and synthesized. The results of the study revealed some significant issues. First, the data verified by the National Human Rights Commission of Thailand indicate that many large-scale government projects violate community rights due to a lack of complete and transparent process of social, environmental, and health impact assessments. Second, many communities have been seriously affected in terms of health; they have to face with polluted environments, loss of major resources, and affected way of life in the community. These effects reflect injustice in sharing and in access to resources. Third, violations on fundamental right in receiving information; most information about projects lacks clarity and does not cover all the dimensions of the effects that may take place. Fourth, access to the justice process is still limited, as can be seen from the number of cases on environmental conflicts that have been taken place continuously while the development of the justice process on the environment has been very slow. Last, large-scale government projects are still carried out to reproduce community trauma.         From the past to the present, attempts have been made by many parties to find solutions to the problems. As for the author of this article, the lesson should be learned and the body of knowledge should be created from the memories of the past; this can be one way that could lead to positive adaptation. The government sector must recognize the set of knowledge and must understand the differences and complexities of the fact of being a community. Furthermore, the government sector should review and adjust its policy so as to be in line with the context and conditions of the community. The communities themselves should know about themselves in terms of resources and their own rights; they should also learn the lesson of trauma faced in the past by other communities so that they can build awareness of being a community and learn about globalization. Eventually knowledge will become authority for the community and will strengthen the community, too.
